I tried to go to self service and the Apple headphones that come with the phone don't show up under accessories... only the more expensive ones...

Apple Earpods

When I got my new Iphone 5 last year. I tried the new earpods, and got dizzy and nauseous, so I am using the old earbuds, which Apple no longer seems to sell, I bought a whole bunch on amazon.ca. Not sure why the new ones make me dizzy, unless it is the way the sound is directed into your ears. How is everyone else liking the new apple earpods?

What to do with old Macs

What do you do with your old Mac when you replace it with a shiny new one.

I just replaced my 2010 Macbook Air, and I just did not have room to store it, and I did not feel it should leave the family, so I just handed it down to my younger brother, and he loves it, a lot lighter then his clunky big toshiba laptop. I am happy now, since my plans to Macify my family is complete. My brother was the lone holdout...

My mom and dad have iPads, so I guess that is okay for now...

For Sale iPhone 4 32GB and iPhone 4S 64GB - Both Unlocked

I have 2 iPhones for sale.

1) iPhone 4 32GB

This phone was locked to Rogers and I paid for them to unlock it a few months ago. It has been tested with a TELUS sim and works fine. The phone is in awesome shape with very few fine scratches on the screen, the back and sides are near perfect as the phone was always in a case. There is no warranty remaining.

I would rate it a 8.5/10. It is running iOS 6 and comes with an Apple USB cable and Apple charger.

Looking for $200

2) iPhone 4S 64GB

This phone was never locked to a carrier, it was purchased unlocked from Apple. I just received this phone yesterday as a replacement from the Apple Store as my original developed a white spot on the screen. Still has plastic on it. Original warranty has about a week left on it, but because it was replaced an additional 90 warranty is given by Apple for this phone.

I would rate it a 10/10 as it is straight from Apple and has not been used. It is running iOS 6 and comes with an Apple USB cable and Apple charger.

Looking for $450

Located in Toronto and would prefer a local deal, but will ship for established members. Buy with confidence, 10 years on this board with dozens of perfect transactions.

Please, for speedy correspondence please email me directly at maximusbibicus@gmail.com, do not PM. I can send pics on request.

is iOS 7 the death of Steve Job's philosophy at Apple?

I wanna start off by saying that I downloaded iOS 7 and I like most of it so this thread is not meant to bash the new OS. Perhaps it's still because I'm shell shocked by the difference between it and the previous iOS but I feel like certain mundane and seemingly superficial aspects of the OS got me thinking its a bit of a departure for Apple. It almost seems like a shift in philosophy.

For starters, they've flattened the interface and removed the gloss layer. Also many of the buttons have sharper cleaner edges now (like the hang up button or the trash button when swiping to delete in mail). As an apple user, I'm used to a rather round, bubbly interface. Most windows users consider the interface childish and unnecessary but I always felt like that's part of what set Apple products apart; they weren't so square and Bauhaus styled. Simple, clean and functional yet the OS is pleasantly animated. The new iOS design makes me feel like I have a iDevice made by Microsoft or Samsung; it feels like it is function over form, business over pleasure with not a whole lot of charm. I'm also surprised that Apple has gone with fonts and icons that have much less contrast than before. I told my father he should hold out on upgrading because he has poor vision. The previous interface in iOS 6 is easy to read which makes it nice even for "the elders". The ease of use and accessibility for everyone has always been a strength of iDevices in the past.

Another thing that struck me was the sound design for the rings, notifications etc. Apple's "classic" sounds are earthy and organic. The marimba sound became synonymous with the iPhone! African hand drums, xylophones, a guitar strum, even the non musical tones and sounds were charming and organic. The new sound design is definitely a departure from that; they actually have more "song like" ring tones. That brings me back to 2003 when I had a Sony Phillips phone and half the ringtones were Megaman type techno beats. The other ring tones are mostly modern spacey bleeps and bloops. All pretty cold if you ask me.

So all of these observations have had me thinking; is this the result of a year past since the death of Steve Job?. Was his influence/philosophy so great on the Apple line of products that we are now going to see more and more "mainstream" and function over form interfaces that are more square? Is the slight tongue-in-cheek aspect of the interface on its way out the door for a more straightforward interface that is less distinct from other competing platforms?

Apple Increases Prices in Canada on Accessories....

Hi everyone,

Just a heads up. Apple has increased prices on the following in Canada:

Apple Keyboards wired and wireless. Both wired and wireless Mice. All MagSafe Adapters have jumped $10 more. Most of the batteries have increased as well. Magic Trackpad and Superdrive have increased too. Along with some cables.

Effective as of today.

$10 increase on magsafe adapters

$6 increase on most other things.

$10 increase on USB SuperDrive

US Prices remain the same.

So there you have it. Other countries have seen an increase as well, except for the USA.

iPhone 5c (and 5s) AWS reception

Hello,

I was wondering if anyone has tried an unlocked iPhone with one of the AWS carriers (Wind/Mobilicity/Videotron).

I picked up a 5c, and decided to use it with the Wind account I have for my part-time small business. It worked fine at home, but I cannot get a Wind signal at work. My workplace is in a somewhat marginal Wind coverage area, but with my old Sony Xperia, I had Wind coverage at work.

I have to wonder if the AWS 3G receiver in the phone isn't very good, or if this is a pure coincidence and the Wind network is down in my area.

Has anyone else had issues. Going to airplane mode and ever restarting the phone has no effect. It can only see the WIND Away (Rogers) network.

For Sale 2011 Mac Mini 2.3GHz i5 and 8GB mem PLUS Elgato 240GB external SSD

Hi guys, I'm selling off my mac mini setup. I upgraded the RAM to two 4GB modules for a total of 8GB of ram, you'll basically never run out of RAM doing normal or moderate workloads. Aesthetically it's in almost perfect condition, the only wear is on the bottom black part but it's all superficial. I'm selling this for $400 shipped regular parcel but insured for the full price. I could ship it Xpresspost if you want but I'll have to calculate that and add it to the price. I'll do a fresh install of Mountain Lion on the internal drive if you buy this separately but if you decide to do a factory reset it will default back to Lion.

Separately, I'm selling an Elgato external SSD that connects via thunderbolt (new version with cable included). This is the single best upgrade you can do to any mac that has a thunderbolt port. I had this set up as my OS drive while the internal drive in the mac mini was for storage, this combo absolutely rips! OSX boots up in 14 seconds and there is no lag opening up any apps, it's amazing. This also leaves you with potential for having even one more hard drive slot inside the mac mini besides the original 500gb drive. I'm selling this one for $380 shipped in its original box, insured for the full value, regular parcel.

If you want to buy both I'll do $760 shipped regular parcel, insured for the full value. A new mac mini will run you even more than this and for actual user experience, this will blow them away because of the SSD!

I accept Paypal for payment, please PM me!

Before they go on to concur lights or other home devices.. maybe they should first work with all systems before claiming they are 'smart' or revolutionary..

after calling lennox - I have to invest in an iComfort which is $400 [ which I will pass ] not worth it..

Dr. Seuss remembered

Sept. 24, 1991: Theodor (Dr. Seuss) Geisel dies of throat cancer.

His name that was given was Theodor Geisel

Though fans called him Seuss; 'twas a self-made revisal.

Early on he drew ads; then came propaganda

For the U.S. war effort. (He adored the agenda.)

But after the war, he turned focus to kids stuff

Fantastical satires of authorities and their guff

His menagerie bloomed as he cartooned and lampooned

There was a turtle named Yertle and so many buffoons

Thing One and Thing Two, and a Cat with a Hat

A Once-ler, a Lorax - but then, you knew that.

His legacy rich, his influence sublime

Seuss passed one September; there'd be no more rhyme.

Refused Contract Extension - What next?

I've had my iphone 4 since August 2010, and officialy came off contract this August. So I went to my local friendly Telus store to see what my hardware upgrade/contract extension options were. Telus refused to offer me a contract extension unless I changed my current plan:

My Current Phone Plan @ $60 + HST

Call Display

Unlimited Messaging

Visual Voicemail

6PM Local Nights & Weekends

6GB of data

Unless I changed my plan to their current rate (which is apparently $105 ) or changed my plan to something like $70 for 1GB I would not be able to upgrade. I was on the phone with retentions - It seemed impossible to upgrade until my plan was above $70 a month (retentions even recommended I don't extend my contract and I buy my own device)

So my questions are:

1) Has anyone been able to upgrade/extend their contract with a similar plan?

2) How does buying my own device work? Where is the value proposition in dishing out $700 every 2 or 3 years for a new phone?

Apple TV Update: Oops

I've had the Apple TV for almost a year and enjoyed it enough to have cancelled cable TV. There's been a couple of updates that I had no problem with, then the latest one struck. So after an hour of a flashing light and no change, I checked the net to see if others had the same problem. And of course there were lots of them. So I followed some others' advice and now, a day later, it's all working again. Advice: always check first before updating.

late 2007 Macbook intermittent display problem.

When I open up my MB, often it just shows me a black screen.

I have to lower and raise the screen and find just the right spot where it will be on. This has been going on for a couple of months and seems to be getting worse, sometimes having to lower and raise the top/screen a few times before it stays on.

It seems obvious to me it's probably a loose or dirty connection in the ribbon cable and I'm wondering if anyone has had that problem and how much trouble it is to fix..

2008 blackbook keeps crashing...due to external hard drive?

Ever since I hooked up an external hard drive, my system keeps crashing.

The first time I noticed it crashing was when I routed my iTunes library to the external hard drive and played iTunes from that. I have since put iTunes library back onto my Macbook hard drive and it's been fine.

It has recently crashed when transferring 25GB of music onto iTunes, uploading 4GB of MP4s from a CD onto my external hard drive, streaming BB6 and browsing the internet.

I'm using the G-Tech 500GB Slim Portable USB3.0 external hard drive and my system is:

OSX 10.6.8

2.2 GHz Intel Core 2 Duo

4GB RAM

Any idea why it seems to be crashing ever since I've been using an external hard drive??

Saw an ad on Kijiji, which seems to have been repeated by others. The claim is that they took their original Rogers iPhone to Apple because of some warranty issue, and Apple issued them a new unlocked iPhone, which they want to sell to get the new 5S.

The seller says I can copy his drivers licence. His phone number is listed on the ad. Reverse phone lookup does not give any information, but then it does not give any information about any of the numbers I, or family members have.

Messages asking for password repeatedly

Hi all, hoping someone can help me.

I signed out of Messages a while back to try and fix something and when trying to sign back in it essentially rejects my password constantly and asks me to reenter it, instantly. Same thing happens in Facetime.

I can sign into a different iCloud account but not my primary one.

This account still works on other computers in Messages and Facetime and I use it on my iPhone and iPad. I've tried deleting the keychain entries and updating my system software.

Anyone encountered this or any ideas outside of reinstalling the whole damn OS? It seems like it's stuck with that iCloud account and won't let it in no matter what I do! I've tried everything I've found with googling but nothing works.

Alternatives to the iPhone?

Hi all,

So I've had an iPhone since the very early days, before even available in Canada. Purchased in NY, jail broken and very pleased.

Updated to the 4, and have enjoyed the incremental changes. Anyhow, iOS7 has been a massive tun off for me. Although my 4 still works, it is a few years old and I want to upgrade.

For those of you using non iPhones, which phone are you using? How happy are you using? Has anyone switched away from the iPhone and been even happier?

Samsung? BBz10/30, Windows/Nokia? Other?

I am looking for a phone that will play nice with my Mac desktop(personal) and iPad(work)

Thanks

Can I DOWNGRADE friom iOS7?

So I did the update today to iOS7 and well...I can't stand it. I absolutely hate it. I have the iphone 4, but I really dislike everything about this new version.

I don't find it as responsive as it used to be

I don't like the way the windows whiz in from the top,

I don't like the new icons

I can't stand the grey dullness around all my folders

I can't stand that its very androidesque in appearance.

If I wanted an android I would have purchased one.

I also don't like how everything is so 'white'..the phone dial pad, mail, messages..

Anyhow, is there anyway to downgrade? At least I did not update my iPad

I don't think Jobs would have approved of this new iOS....just my two cents

NAS concepts

I rarely watch TV, and do most of my watching online. As a result, I've got a huge library of videos from YouTube, iPlayer etc. Everything that comes in gets converted, if necessary, and added to iTunes. (isn't iPlayer Automator fantastic?)

Since we have 2 MBP's, 2 iPads and 2 iPhones, I've been looking at NAS devices and have just splurged on a DLink DNS 325 that I've populated with WD Red discs. I think that will allow all users easy access to programmes and should make it easier for SWMBO to watch her "Lewis" or "Morse" mysteries.

So here's my question - its more of a concept question than anything else.

Do I take it that what I should do is to name a volume on the iTunes server in the DNS 325 - basically, this will just tell it where to store the media files on the NAS?

Next, do I then copy all of the media files into that location on the NAS?

Finally, do I then go into iTunes Advanced settings and change the iTunes Media Location to the volume on the NAS?

When I read the User Manual, it seems very confusing - but I wonder if it isn't just as the same idea as plugging an external drive into an Airport Extreme and using that for media - the only benefit of the NAS is that it is easier for all users to get to.

Can anybody offer any help?

Thanks

Walt

Garage Door Openers

I recently moved into a new house.

so we have been researching openers.. so I hope this helps others

I was going to get your 'top notch' home depot brand.. but based on my last experience with the how bad it was installed by them and loud - when sold as whisper I was reluctant.

- requirements: silent, belt driven, DC Motor, battery back up - Smart home compatible.

I came across LiftMaster 8550 8550 - Elite Series® DC Battery Backup Belt Drive

I am speechless, it is super smooth cant tell it is in operations not to mention no jerkiness

it zooms up and then slows, same when closing..

the cool feature is I can open and close it with my iphone from any where in the world.. :D

it chimes 4 times before closing to notify those near the door it will be closing, what I do like as well, I receive notifications on my iphone when it is open and closing..

The panel in the garage shows battery life, plus temperature of garage..

Pricing various extremely, but I bought it for $430 installed plus taxes..

the second door I had to install a Jack shaft operated one because of space and size of our doors.. same features and frees up your ceiling as it is wall mounted.

liftmaster 8500 - once again - prices various from retailer extremely.. but I bought mine for $475 plus taxes.

8500 - Elite Series® Model 8500 Wall Mount Garage Door Opener

if any one has questions - feel free to ask - happy to answer.

Comparison:

homedepot brand $239 + $130 install

liftmaster $430 installed..

$61 for a better smoother opener and super silent with tons of features.

no brainer.

Mac only finds network under 2.4 GHz wifi not 5 GHz

I currently have a mixed Windows and Mac environment which has been operating well for some time but I have one problem which I hope can be fixed by an expert here.

Under 2.4 GHz wi-fi, my daughters iMac connects to the internet, connects to my windows and mac computers, works with a Time Machine drive on another Mac, and can successfully print on our network printer.

If we switch to 5 GHz wifi, her iMac can connect to the internet but cannot connect to other Windows or Mac computers, cannot back up to Time Machine and can't find our network printer.

Is there a setting that I need to adjust to get everything working under 5 GHz wifi?

Thanks in advance.

Pre order thoughts

More & more over the last several years are these (tech)? companies announcing upcoming new products, then demo-ing them live, then they tell us that they can start being pre ordered in the next week or two. Is it a way to test the markets reactions to the new products, or some other reason(s).

Just my pet peeve I guess... why not just wait an extra week or two to demo the product, when its actually available.

Any thoughts or opinions out there?

iPhoto help please

Cue music from Twilight Zone.

Here's the deal. I've had an iPad since the beginning. I have an iPhone. I've had iPod Touchs since the beginning. I have a Macbook Air.

In the past I've had digital cameras, and a variety of MacBooks and earlier PowerBooks and iBooks.

In other words, I've had many devices with which I could take digital pictures, not to mention the various scanners and digital prints on CD. In 2007, the hard drive on a new Macbook crashed and I lost all those digital images.

Fast forward. I'm scanning some old pictures for use in a family history. I also download a lot of pictures from the net to use in the really nice jigsaw app on my iPad. Needless to say, my photostream has grown huge and I realized that my newly scanned image were getting lost among the jigsaw pictures.

So I set about finding a way that I could remove unwanted pictures from my photo stream. In the finder, I located the pictures "Masters" folder and copied it to the desktop thinking I could use the finder to quickly eliminate the images I don't want.

The Masters folder contains folders by month and by day within each month. I opened folders and trashed images I don't want. There are a gazillion folders that are empty when viewed in the finder, so I trashed them too.

Then I accidentally trashed a picture I wanted to keep so I opened trash, searched for .jpg to find all the images. I started to scroll through the images to find the one I accidentally trashed and to my surprise, I found pictures from my mother's birthday in 2005!!!!

I don't have hard copies of those pictures, they would have been on the crashed hard drive. When the drive crashed, I lost everything. Those pictures should be gone forever. How in heck did they end up in the trash of my new Macbook Air? I don't have hard copies, so NO, I didn't scan them and forget about them.

And, why didn't I see them when I was looking in that Masters folder in the finder?

Is there some secret backup of iPhoto? Are my pictures floating in the ether? It's magic.

Can anyone explain?

iPhoto library advice / support ???

Lately, my iPhoto (or my computer) just doesn't seem to be managing with the weight of my photo library. I need some advice on how to better deal with this.

I have just come across a post for iPhoto Library Manager - it sounds interesting - but before dropping $30.00 I'd like to hear what others are doing.

I'm running a Mac Mini (see specs below).

My photo library has 98.4 GB of photos (over 9500 photos and videos).

I'm not sure how it would work with separate libraries (can more than one be opened at a time? How do you choose which library to open).

I'm sure that my computer can handle my photo collection, I just need a better way to organize it.

BTW - the photos are not for professional use, so I don't search back too often, but I still want easy access to them for when people are visiting and I want to access that trip I took a few years ago or that time when my first kid was born.

Thanks for your ideas...

Dice Roll Simulator in Numbers

I have it set up nicely, imported from Excel and tweaked it.

Normally on a PC you "change" the roll by hitting F9. My F9 is the showing of the open folders and sites, etc. I change the roll with the Delete key. Any other key to change the roll?

Mac security and privacy

How can a new MacBook Air 11" be set up so that it does not pass on any information to Apple or anyone else, except for information that we specifically want to send?

Some while ago I asked on here who was our iMac sending information to. Various members suggested some apps to check on this. I appreciate their responses. However thanks to the disclosures of various whistle blowers readers will be aware that Apple and other computer, internet and telcom companies are agents of the NSA and GCHQ. The disclosures indicate that normal anti-virus software and similar apps cannot detect this spying. I presume this applies to the apps suggested as answers to my previous query.

How can ordinary people retain computer and online privacy? A search came up with some suggestions:

How do I secure my Mac? This is one example from this forum. It provides general advice that will work against casual snoops but will probably be ineffective against major spy agencies, both government and criminal.

http://www.nsa.gov/ia/_files/factshe...ening_tips.pdf From the NSA itself. It seems logical that the NSA's advice is general advice that will not secure any computers against the NSA and its agencies and cronies, and similar operators.

Neither addresses any built-in spy features of OSX. What has Apple put in OSX that will facilitate breaches of privacy? Are there hidden backdoors, automatic telltales and other means to pass information to snoops?

I recently had an interesting experience. I have been considering buying a MacBook Air 11" for my wife. I checked prices in Canada, both at Apple stores and at resellers. I checked prices at Apple stores in the USA. All queries worked as expected. I then decided to check the prices at Apple resellers in the adjoining state. I clicked on the link for resellers and a form page came up. I inserted the Zip code for the nearest city in the adjoining state and hit return. It came up with the same blank form. I tried again but this time it came up with some resellers in Scotland. I twice tried the process again starting at the beginning of Apple.com putting in the names of two cities in this state along with the state's name but the same happened. In each case I should have received a list of resellers in the state but instead received reseller information for the UK although I did not supply any information connected with the UK. It seems something was sent to Apple either then or in the past that indicates that I might have some connection with the UK and that overrode my normal input to the resellers form. What else is Apple stealing from our iMac, storing about us and who is it passing it to? Has anyone analysed OSX to find out exactly what is included in it and what it does without a user's input?

How can a new MacBook Air be set up so that it does not pass on any information to Apple or anyone else, except for information that we specifically want to send?

If it cannot, then what alternative computer and OS to a MacBook Air 11" using OSX would readers suggest we obtain?

Factory Unlocked iPhone 5 at WalMart for $549

Here in the US, WalMart has dropped the price of the iPhone 5 by $100, to $549. It's on their straight talk plan (pay as you go), but AFAIK you can buy the phone without activating it, and it's factory unlocked.

Anybody offering this in Canada for that price?

circa 2008 black Macbook: update 10.6.8 to next level

When I updated my system to 10.6.8 last year, a lot of advise suggested this would be the maximum to update it to as a more current OSX would not run as smoothly and perhaps even cause some problems.

I'm attempting to download Adobe Lightroom and it requires 10.7 minimum.

Time to buy a new machine or take a risk and update it to 10.7?? Are the previously mentioned concerns with updating indeed true today?

Best external hard drive for Mac

I'm using a Seagate Backup Plus (not for Mac), and everytime I put my iTunes library on it and play, my system suddenly restarts at some point during playing music. I'm guessing it's not a greatly compatible hard drive for my 2008 black Macbook (10.5.8).

So I'm considering ditching it and getting a hard drive specifically for Mac such as a WD My Passport 1TB 3.0 or G-Tech 1TB. I had a seminar with a photographer who recommended the G-Tech since he's used them, didn't highly recommend La Cie and said he's heard good things about WD.

Any suggestions which brand to go with? On Apple's site, the feedback for WD is horrible, G-Tech is mostly very good and I haven't looked at La Cie since he didn't even recommend them.

I cant seem to get rid of the duplicate, they are all the exact same name song length, etc, so an exact duplicate. Isnt iTunes match supposed to detect duplicates and get ride of them?! What can I do to get rid of duplicates in the cloud?

IPad mini buying question.

Hi, I would like some buying advice. Walmart has a 16gig mini on sale for 298, Future Shop has a 32 gig mini for 409. I'm leaning towards the mini as every I see with an iPad has a mini. The sales also may be an inventory adjustment indicator for an updated iPad to come. But at 298......seems like a good deal as there are no refurbs in Canada and the US refurbs are around the same price. Thoughts....

Google knows nearly every Wi-Fi password in the world!

Yikes!

Google knows nearly every Wi-Fi password in the world | Computerworld Blogs

Quote:

If an Android device (phone or tablet) has ever logged on to a particular Wi-Fi network, then Google probably knows the Wi-Fi password. Considering how many Android devices there are, it is likely that Google can access most Wi-Fi passwords worldwide.

...

The bad news is that, like any American company, Google can be compelled by agencies of the U.S. government to silently spill the beans. When it comes to Wi-Fi, the NSA, CIA and FBI may not need hackers and cryptographers. They may not need to exploit WPS or UPnP. If Android devices are offering up your secrets, WPA2 encryption and a long random password offer no protection.

Intermittent Wifi Issue + iMac

Argh!

I realize this has been touched on before (and likely by me) but I wanted to start fresh and try to resolve this issue.

The wifi reception on my 2011 27" 2.7GHz iMac running SL keeps stalling out. The other machines in the house, using the same Bell Sagemcom router, have no issues whatsoever. They are two Macbooks, both running SL as well as iPhones and Apple TVs.

It's the same pattern every time. The machine boots up, wifi signal is strong, go to a page, read for awhile, try to go to another and nothing. Maybe sometimes a few pages before it happens but it always happens. Signal still indicates full strength.

Turn airport off, turn it back on, the signal catches and all is fine for a little while. Annnd, repeat.

I have done many things to try and correct this. I have made sure there are no other interference causing devices present. I have rebooted the modem. Lather, rinse repeat.

'Perhaps it's your modem' you'll suggest. 'Well no' I'll reply. It was happening with a 2Wire modem from Bell prior to this one.

If anyone has any ideas I'd love to hear them. The frustration factor is growing by the day.

Thanks all!

iPhone 4 Price Check

Hey All,

I am probably going to be upgrading my iPhone in the not to distant future. What is a fair price for an iPhone 4 16GB (unlocked by Rogers properly)?

Condition is 9.5+ out of 10. It has been in an Otterbox Defender since the day it was picked up from the Apple Store as a replacement device (buddy fell into a pool with his, he ended up just buying a brand new one and i was able to return the damaged one and buy the replacement at the out of warrantee replacement cost).

Is $200 a fair asking price? Or am i dreaming? Ipo2sell.net says it's worth $240, but i believe they overprice stuff sometimes.

NAFTA, Chapter 11

Among many other reasons, this is why the North American Free Trade Agreement (and most modern FTA accords) are ultimately bad news for sovereign nations: they constrain the ability of the federal (and local) government from acting in the interests of the people while ensuring that corporations can operate in the best interests of their shareholders / profit motive. The profit motive has no place in the creation of a just society.

Eli Lilly files $500M NAFTA suit against Canada over drug patents

Eli Lilly is accusing Canada of violating its obligations to foreign investors under the North American Free Trade Agreement by allowing its courts to invalidate patents for two of its drugs.

The company officially filed a complaint this week with NAFTA seeking $500 million US in compensation.

* * *

The NAFTA claim alleges that several Canadian court rulings invalidating the patents for Eli Lilly's drugs Straterra and Zyprexa were illegal under international law because they violated Canada's obligations under Chapter 11 of NAFTA, the international trade treaty that covers the U.S., Canada and Mexico.

Chapter 11 protects the investments of companies and investors from NAFTA countries that operate in other NAFTA states. Eli Lilly alleges Canada violated the provisions of Chapter 11 that guarantee fair and equal treatment to foreign investors and protect them from expropriation of their investments.

* * *

The company argues that by not rectifying the "judge-made law" on utility that expropriated Eli Lilly's exclusive rights as the patent holder, the government was guilty of expropriating Eli Lilly's investments, the company said, which is prohibited under Chapter 11 and entitles the company to compensation "equivalent to the fair market value of the expropriated investment."

* * *

The Council of Canadians, the Washington, D.C.-based government watchdog organization Public Citizen and the global consumer rights group Sum of Us have all spoken out against Eli Lilly's complaint, and Sum of Us created an online petition calling on Eli Lilly to drop the suit.

Eli Lilly's NAFTA complaint is unprecedented and should worry the citizens of Canada and other NAFTA countries because the drug maker is not only challenging the invalidation of its particular patents but is challenging "Canada's entire legal doctrine for determining an invention's 'utility' and, thus, a patent’s validity," Public Citizen wrote in a brief on the case.

"While pushing for an entirely different patent standard, Eli Lilly, the fifth-largest U.S. pharmaceutical corporation, is demanding [$500 million] from Canadian taxpayers as compensation for Canada’s enforcement of its existing patent standards."

* * *

In an interview with the American online news magazine Politico, Toronto attorney Lawrence Herman, a former trade official with Canada's foreign service, agreed that Eli Lilly is less interested in compensation than in changing Canada's patent law so that judges no longer have the leeway to make the kind of rulings they did in its case.

Off contract cell phone plan prices?

I'm currently off contract and with Rogers. I have an unlocked iPhone 5 and would like to know what you guys are paying for service who are off contract. I do have the $30 6 G data plan along with 250 mins talk and unlimited texts for around $30-35 per month. Do you think I could get a better deal with Rogers or elsewhere since I no longer have a contract.
